Cohabitation Agreements

A cohabitation agreement is an understanding between two unmarried persons who live together as to how they have agreed to treat their individual assets and how they agree to manage, control, acquire and dispose of assets in the event the relationship terminates. The advantage of a cohabitation agreement is that, if properly drawn, it will reduce the stresses that would be involved if the cohabitation relationship terminates.

Incestuous Marriages

An incestuous marriage is a marriage between close family members. The validity of an incestuous marriage depends on the law of the state where the parties intend to reside. In the state where the incestuous marriage is regarded as a crime, the incestuous marriage is not accepted for immigration purposes even if the marriage was legally contracted somewhere else.

Notice Requirements, Leave, and Enforcement of the Family Medical Leave Act

The employer is required to keep and post a notice of the FMLA requirements in an open and obvious location for its employees to see. The notice should contain information about filing complaints if the employer fails to comply with the requirements of the FMLA. The information should also address issues regarding the employee's rights and the employer's obligations under the FMLA.

Proxy Marriages

A proxy marriage is a marriage where the parties were not physically present in the presence of each other. Someone stands in for the other party because either the bride or the groom is not physically present for the wedding. During the solemnization of the marriage, based upon a power of attorney, an agent acts on behalf of one of the parties. The marriage is presumed valid if it is valid in the country that performs the ceremony.

Raising Grandchildren

In this day and age there are a lot of grandparents raising their grandchildren for numerous different reasons. Sometimes the grandparent may seek custody of their grandchild due to the parents' incapacity to raise the grandchild. Other times the grandparent may have no choice but to raise the grandchild due to the situation at hand.
