  • Child custody
  • Child support
  • Pre-nuptial agreements
  • Alimony
  • Property division
  • Paternity

Mr. Bardi understands that when your life undergoes a major change like a divorce, the last thing on your mind is paying attorney fees.  That is why Richard C. Bardi's law firm works with family law clients to conserve money that would be better spent on your family and on starting your new life.

Relocations

In family law, relocation refers to one parent's intention—during separation, during divorce, or after the divorce—to move away from the other parent.  There is also child relocation, in which the custodial parent wishes to relocate the child out of the area.  These situations require a redrafting and reevaluation of child custody agreements.  The court examines the parenting plan and determines the levels of harm and benefit to the children involved.

Relocation is nearly always emotionally difficult and complicated.  It is easy to make a mistake when trying to abide by divorce agreements—a misstep in relocation could result in a parental kidnapping charge.  It is critical to involve an attorney with experience in family law and litigation to protect you, your family, and dispute or prevent a parental kidnapping charge. Post-divorce modifications

A significant change in circumstances may cause you to revise the terms of your divorce. Changing terms of settlement agreements to fit your new life can be extremely complicated.  These alterations can affect alimony, child support, child visitation, and more.  Whether you want to renegotiate the changes with your spouse first or go through attorneys, you need a legal team experienced in post-divorce modifications and Massachusetts family law.  Contact Richard C. Bardi.

Domestic violence

  • Domestic assault and battery
  • Stalking

  • Felony domestic violence

If you have a domestic violence charge on your record or if you have been the victim of domestic assault, the Law Office of Richard C. Bardi can help you.  The firm's experience in criminal law creates a strong foundation for your domestic violence issue.  The lawyers do their best to see that justice is served in both criminal and family courts.

Selected cases

Pre-nuptial agreement held valid

Attorney Bardi represented a husband in a divorce action which involved the issues of child custody, division of assets, and enforcement of a pre-nuptial agreement entered into by the parties prior to their marriage. It was the husband's second marriage. Before the trial Attorney Bardi negotiated a resolution of all child related issues. The primary issue at trial was the enforceability of the pre-nuptial agreement. The wife objected to the enforcement of the pre-nuptial agreement and sought alimony from the husband, which was precluded by the terms of the pre-nuptial agreement. The wife chose to work part-time so that she could spend more time at the gym. After a trial the Judge determined that the pre-nuptial agreement was valid because enforcement of the agreement left the wife with sufficient assets and she had the ability to support herself through employment should she choose to work fulltime.

Retained business ownership after divorce

Attorney Bardi represented a wife who was a co-owner of a successful business with her husband. After a hotly contested divorce, Mr. Bardi reached an advantageous division of the couple's marital assets on behalf of his client that included retaining her control of the business, as well as receiving sole legal and physical custody of the children.

Stay-at-home mom wins rights

Attorney Bardi represented a stay-at-home mother. The husband was the co-owner of a successful chain of supermarkets along with his brother. After trial, Mr. Bardi's client was awarded full legal and physical custody of the children, a large financial buyout of her marital interest in the supermarkets, the marital home, child support, and alimony for life.
