Selected Cases — Domestic Cases

  1. Divorce — Norfolk Probate and Family Court — Represented wife in a dispute over the division of the parties’ $12 million+ marital estate. Wife had given up her career as a CPA to become a homemaker when the parties’ first child was born. After a 13-year marriage, husband argued that wife had no interest in nearly $4 million of husband’s premarital assets. Wife received what amounted to essentially 50 percent of all of the parties’ assets, inclusive of all premarital assets.
  2. Divorce — Middlesex Probate and Family Court — Represented the wife who was terminally ill and a victim of domestic violence. During the divorce action and as result of husband’s deceitful behavior, counsel had the court order husband to move out of the marital home so wife could reside there during the divorce. After a two-day trial, the judge also agreed with attorney Bardi’s arguments and ordered husband to reimburse wife over $20,000 for money husband withdrew from the parties’ joint account, for marital property husband sold and an award of legal fees to wife.
  3. Divorce — Middlesex Probate and Family Court — Representation of husband who was president of an international corporation out of Belgium. The case settled with the husband keeping all interest in the corporation valued at approximately $30 million.
  4. Divorce — Suffolk Probate and Family Court — Representation of wife/lawyer who was married to an attorney who specialized in labor law. The husband refused to return to work after the child was born. Husband preferred to work at a coffee shop. The husband/lawyer was found in contempt numerous times with failure to comply with a job search. Ultimately, at trial, the court imputed $80,000 to the husband/lawyer based upon his refusal to work in an area consistent with his education and law license as opposed to being a barista in a coffee shop.
  5. Divorce — Norfolk County Superior Court — Represented wife/co-owner of a successful bakery. Despite husband’s claims that he was the driving force behind the bakery, the court ordered the husband to release his interest in the bakery and provide it to the wife.
  6. Divorce — Essex Probate and Family Court — Modification action whereby former wife sought to move out of the county in excess of a 10-mile radius of the former marital home. The separation agreement provided that the wife and child would remain within a 10-mile radius of the marital home. Former wife was precluded from violating the terms of the separation agreement and was required to remain within a 10-mile radius of the former marital residence in order to avoid interference with the father’s parenting time.
  7. Divorce/domestic violence — Middlesex Probate and Family Court — Husband obtained a restraining order against wife who struck him with a dog chain. The husband was a fire fighter who suffered years of abuse from the wife. Wife was found in contempt of court for failure to vacate marital residence.
  8. Domestic Relations/custody — Middlesex Probate and Family Court — Father, who was given only two hours a week of visitation with his sons, was granted full parenting time/visitation rights during a modification action. Subsequently, the former wife/mother brought false allegations of abuse by the father on the children. The court found the allegations to be false and unsupported by witnesses, photographs and documentation. Mother was stripped of her custodial rights, and the children were placed in the custody of the father with full physical and legal rights.
  9. Divorce — Essex Probate and Family Court — Defended a man whose former wife had been convicted of a second-offense operating under the influence charge and refused to allow father to care for son while she entered into a 14-day program. The court agreed that the former wife was unfit to care for the child and awarded full custody to the husband, both legal and physical, without any visitation schedule as well as an award of child support to the former husband.
  10. Divorce — Middlesex Probate and Family Court — Defended store owner who had a successful shoe business valued at approximately $1 million prior to the economic downfall. The husband demonstrated through a business valuation and expert testimony that the business had lost its value. Husband was allowed to keep the business without paying any compensation to the wife.
  11. Divorce — Middlesex Probate and Family Court — Modification — Former husband lost his employment overseeing charter schools as a result of an alleged sexual harassment. He filed a modification action seeking a reduction in child support payments due to his unemployment as well as his pursuit of a new career. Court denied the former husband’s modification of child support and awarded retroactive child support in excess of $10,000 as well as an award of legal fees of $10,000.
  12. Divorce — Essex Probate and Family Court — Represented an individual who held a high ranking position in the Andover school system who was found to have an inappropriate relationship with a co-worker. Husband was permitted to keep his full pension in exchange for a disproportionate property division and life insurance coverage.
  13. Divorce — Essex Probate and Family Court — Converted a divorce action to an annulment action when an investigation lead to the discovery that the husband was married to another woman along with a family that lived in London, England. Court awarded disproportionate distribution of the marital estate to the wife.
  14. Divorce — Middlesex Probate and Family Court — Represented the husband whose family owned five nurseries. Demonstrated that the wife had not valued the properties correctly. The husband’s interest was nominal in nature based upon a trust agreement in the closely held corporation.
  15. Divorce — Essex Probate and Family Court — Defended an attorney whose marriage settlement was achieved by way of a cap on all support payments. The value was attributable to the husband’s law practice.
  16. Divorce — Essex Probate and Family Court — Modification — Former husband refused to contribute to son’s college education. Court ordered husband to pay one-half of the college tuition cost based upon public college tuition rates.
  17. Divorce — Essex Probate and Family Court — Prenuptial Agreement — Court enforced a prenuptial agreement in favor of the husband where the wife was not awarded alimony based upon the prenuptial agreement and her lack of any serious desire to seek gainful employment.
  18. Divorce — Middlesex Probate and Family Court — Modification — Father awarded custody of the minor daughter, stating it was in the child’s best interest to live with the father as opposed to the mother, who suffered from mental health issues which affected the mother-daughter relationship.
